JAKARTA – Jasa Raharja memastikan, setiap penumpang angkutan umum yang sah, baik
moda transportasi darat, laut, maupun udara, terjamin oleh Jasa Raharja. Hal itu sebagaimana tertuang dalam Undang-Undang No. 33 Tahun 1964 tentang Dana
Pertanggungan Wajib Kecelakaan Penumpang Umum.
Direktur Utama Jasa Raharja Rivan A Purwantono, menjelaskan, bahwa korban yang berhak atas santunan adalah setiap penumpang sah dari alat angkutan penumpang
umum yang mengalami kecelakaan diri, yang diakibatkan oleh penggunaan alat angkutan umum.
Jaminan itu, berlaku selama penumpang berada dalam angkutan tersebut.“Yaitu, saat naik dari tempat pemberangkatan sampai turun di tempat tujuan,”ujar Rivan di Jakarta, Jumat (6/01/2023).
Rivan menambahkan, dalam undang-undang tersebut juga dijelaskan, bagi penumpang
kendaraan bermotor umum, yang berada di dalam tenggelamnya kapal ferry, maka kepada penumpang bus yang menjadi korban, akan diberikan santunan ganda.
Hal itu, karena yang bersangkutan telah membayar iuran wajib (IW) secara double, yakni kepada pengelola bus yang ditumpangi dan kepada pengelola angkutan laut.
“Sedangkan bagi korban yang jasadnya tidak diketemukan dan atau hilang, penyelesaian santunan didasarkan kepada putusan pengadilan negeri,” papar Rivan.
Besaran santunan bagi korban kecelakaan penumpang angkutan umum, lanjut Rivan, telah diatur sesuai Keputusan Menteri Keuangan RI No.15 Tahun 2017, yakni Rp 50 juta untuk korban meninggal dunia yang diserahkan kepada ahli waris yang sah, maksimal Rp 50 juta untuk korban cacat tetap, dan jaminan biaya perawatan maksimal Rp 20 juta
untuk korban luka yang dirawat di rumah sakit.
“Bagi korban meninggal dunia yang tidak mempunyai ahli waris yang sah, maka akan diberikan penggantian biaya penguburan
sebesar Rp4 juta,” ujar Rivan.
Rivan mengatakan, penumpang angkutan umum yang sah, adalah mereka yang telah membeli tiket angkutan umum atau angkutan wisata secara resmi dan sudah termasuk iuran wajib Jasa Raharja. Hal itu, sesuai dengan Surat Edaran (SE) Menteri Pariwisata dan Ekonomi Kreatif/Kepala Badan Pariwisata dan Ekonomi Kreatif RI Nomor SE/8/DI.01.01/MK/2022 tentang Keselamatan Transportasi Wisata.
Dalam poin (a) isi SE itu menyebutkan, kata Rivan, bahwa pengguna jasa transportasi wisata (biro perjalanan wisata dan wisatawan), menggunakan transportasi wisata yang
sesuai dengan persyaratan teknis dan laik jalan serta memiliki perizinan resmi.
Sementara dalam poin (d), juga disebutkan bahwa perusahaan jasa transportasi wisata yang telah memiliki izin resmi memastikan telah melakukan pengutipan iuran wajib (IW) sebagai bentuk tanggung jawab dalam memberikan jaminan perlindungan dasar pada wisatawan yang menjadi korban kecelakaan penumpang umum.
