SWARNANEWS.CO.ID, JAKARTA | Majelis Hakim Pengadilan Tata Usaha Negara (PTUN) Jakarta menunda pelaksanaan sidang gugatan Perkara No.154/G/2021/PTUN-JKT antara pihak Pro KLB Deliserdang (Penggugat) dengan Menkumham (Tergugat) dan DPP Partai Demokrat (Tergugat II Intervensi), Kamis (23/9).

Penundaan ini disebabkan Penggugat, Yosef Benediktus Badeoda, yang sebelumnya bergabung dengan pihak KSP Moeldoko secara tiba-tiba mencabut gugatannya sesaat sebelum sidang Pengadilan TUN dimulai. Hal ini terungkap ketika diawal sidang Ketua Majelis Hakim, Bambang Soebiantoro menyampaikan adanya surat dari Yosef sebagai Penggugat yang mencabut Surat Kuasa kepada Pengacaranya, sekaligus mundur sebagai Penggugat dari Perkara ini.

Menanggapi hal tersebut, kuasa hukum Partai Demokrat, Bambang Widjojanto, menyatakan, “Kami mengucapkan terimakasih dan memberikan apresiasi kepada Bung Yosef yang telah mencabut gugatannya siang tadi. Ini adalah bentuk kepeduliannya terhadap masa depan Partai Demokrat dan komitmennya terhadap demokrasi di Indonesia.”

Bambang melanjutkan, hal ini patut dicontoh oleh para peserta KLB ilegal lainnya yang masih merasa dirinya kader dan mengaku ingin membesarkan partai. “Kalau merasa dirinya kader tapi terus mengganggu, justru harus dipertanyakan kekaderannya,” tegas mantan Pimpinan KPK ini.

Kelanjutan Sidang PTUN

Bambang Widjojanto juga menyebutkan bahwa dengan adanya pencabutan gugatan ini sudah sepatutnya Majelis Hakim mengambil sikap untuk mempertimbangkan kelanjutan dari gugatan tersebut.

“Alasannya, gugatan ini mereka ajukan secara bersama-sama, bukan sendiri-sendiri sehingga jika ada salah satu Penggugat yang mundur semestinya gugatan otomatis gugur,” jelas Bambang Widjojanto.

Terkait agenda persidangan selanjutnya, Heru Widodo yang juga Anggota Tim Hukum Demokrat menjelaskan, sidang lanjutan perkara ini akan dilaksanakan pada hari Senin 27 September 2021, dimana Majelis Hakim akan mendengarkan sikap dari Para Pihak sehubungan pencabutan Surat Kuasa dan Gugatan ini.

“Kita lihat sikap Majelis pada sidang selanjutnya, apakah dengan pencabutan gugatan ini Perkara ini akan dilanjutkan atau digugurkan ?”

Lanjutnya, “Namun yang terpenting, sekali lagi terimakasih Bung Yosef, mudah-mudahan hal ini juga dapat menginspirasi Penggugat lainnya, demi demokrasi dan kepastian hukum di Negeri kita,” pungkas Heru.
